Blake Lively Dealt Major Blow As Judge Blocks Her Subpoena


The actress had subpoenaed Baldoni for his text messages and call logs in an attempt to find “receipts” to prove that he orchestrated a smear campaign against her.

However, a judge has denied Blake Lively’s request for Justin Baldoni’s call and text data, branding it as “overly intrusive.”

Lively suffered a loss in court amid her legal feud with Baldoni after trying to gain access to more than two years of the director’s call and text data.

The 37-year-old had asked for  “documents concerning ingoing and outgoing calls or text messages … within the time period of December 1, 2022 to the present.”

Lively specifically requested for his “call logs, text logs, data logs, and cell site location information.”

Unfortunately for Lively, New York judge Lewis Liman ruled in Baldoni’s favor, noting that her request could lead to the release of sensitive information linked to doctors and psychologists and also communications with people who aren’t related to their case.

The judge also questioned Lively’s reason for requesting call and text data from two years before Baldoni’s alleged 2024 smear campaign against her began.

“Lively mainly argues that the subpoenas will help to identify ‘the larger network of individuals’ who perpetuated a negative media campaign against her,” Judge Liman said, per the Daily Mail.

He continued, “But according to Lively’s complaint, this negative campaign did not begin until approximately August 2024 … it is therefore unclear how communications to and from Wayfarer Parties in 2022 and 2023 would reveal individuals who participated in the campaign.”

Although her request was denied, Judge Liman did not completely shut out the mother of four, as he told Lively to rework her subpoenas.

The judge also slammed an argument by Baldoni’s lawyers as they attempted to block Lively from asking third parties for similar discovery materials in her quest to prove he initiated a smear campaign against her.

“The Wayfarer parties may assert a privacy interest in their own phone records, but they have not provided any basis for asserting an interest in non-parties’ communications,” Judge Liman stated.

Lively’s attorney had previously claimed that by initiating this discovery process, the actress could “expose the people, tactics, and methods that have worked to ‘destroy’ and ‘bury’ her reputation and family over the past year.”

They noted that these “receipts” are “nowhere to be found on Mr. Freedman’s website,” referencing Baldoni’s lawyer, Bryan Freedman, and a website where the actor shared his side of the feud.

In response, Baldoni’s lawyer slammed Lively’s subpoenas as a “massive fishing expedition” that proves the actress and her representative are “desperately seeking any factual basis for their provably false claims.”

“They are asking for every single call, text, data log, and even real-time location information for the past 2.5 years, regardless of the sender, recipient, or subject matter,” Freedman further said while also noting Lively would find nothing to prove her claims.

Lively recently filed an amended complaint in which she asserted that two of her “It Ends With Us” co-stars, who have not been named, will provide testimony supporting her allegations against him.

The “The Age of Adaline” star claimed the two actresses also suffered uncomfortable experiences with Baldoni; however, she refused to name them or share screenshots of texts to protect their privacy.

“Importantly, however, these victim-witnesses have given Ms. Lively permission to share their communications in the Amended Complaint as they are laid out, and they will testify and produce documents in the discovery process,” a rep for Lively said, per the Daily Mail.

In her amended complaint, Lively alleged that she texted a mutual friend of hers and Baldoni that the “It Ends With Us” director was acting like a “creep” towards her.

According to PageSix, the text in question was sent on May 24, 2023, in which the “Gossip Girl” star told the unnamed woman, “I was gonna invite you to set tomorrow. These people. Whoa . . . It’s like HR nuts today. The both of them,” referring to both Baldoni and Wayfarer co-producer Jamey Heath.

She also told her friend that she went home and “cried,” describing Baldoni and Heath as “creeps.”

“Like, keep your hormones to yourselves. This is not mine. I don’t want it,” the alleged text read.

She also wrote, “I don’t want you [sic] gaze or words or tongue or videos of your naked wife,” referring to a video Heath showed of his wife giving birth naked, which Lively claims she “thought” was porn at first.

Lively concluded her message by saying, “It’s shocking. Clowns.”

Baldoni has since responded to the amended complaint, with his lawyer, Freedman, branding it “underwhelming.”
