Alba filed for divorce on Friday, enlisting the help of famed divorce attorney Laura Wasser.
Cash also filed for divorce soon after his estranged wife, with attorney Adam Lipsic helping with his filing. However, the former couple’s filings were very much similar.
Sources told TMZ there is no prenup in Cash and Warren’s divorce, which is also “extremely amicable.” The former lovebirds sought joint physical and legal custody of their three kids, who are aged 16, 13, and 7.
Meanwhile, the date of separation listed on the divorce filing is December 27, 2024.

After news of Alba and Cash’s separation made headlines in January, a legal expert, Goldie Schon, spoke to The U.S. Sun about the potential costs the actress could incur.
Schon explained that Alba could lose a huge amount of money whether or not she and Warren had a prenup.
“Even if there is a prenup, and she gets to keep what is hers, therefore, the Honest Company, which is quite lucrative, that will not stop the issue of spousal support.”
Schon added, “We have evolved when it comes to prenuptial agreements, and we’ve had some very large cases, historically, that have caused prenuptial agreements to not be able to terminate spousal support between couples that are about to marry.”

The legal expert explained that if a prenuptial agreement states that neither party will receive spousal support, the court still has the power to override it.
They noted that if the court deems the agreement unconscionable, it can dismiss the clause and order spousal support as if the prenup never existed.

High-Stakes Divorce Could Cost Alba Millions

Schon suggested that Alba and Warren’s 16-year-old prenuptial agreement may no longer be valid. When they married, Alba wasn’t earning the millions she does now. Hence, if the court finds the prenup unreasonable, it could be dismissed, significantly impacting financial settlements.
Since their marriage qualifies as long-term under California law, there’s no set duration for spousal support. Schon explained, “Spousal support would continue until somebody passes or somebody then returns to court and tries to terminate it or modify it.”
She added that courts cannot impose a strict timeline, stating, “The only two people that can make that agreement are the parties.” Warren could receive over $100,000 per month in support.
Alba may owe over $60,000 monthly in child support for their three children, plus additional expenses. Goldie noted, “Child support is for the best interest of the children… to live in the lifestyle of both parents.”
She emphasized that high-profile divorces involve costly extras like security, private schooling, and luxury travel. Ultimately, “Jessica may not only pay a base amount but also a higher share of additional expenses due to income disparity,” Goldie concluded.

Alba broke her silence on her and Warren’s separation via a post on social media in January.
She wrote, “I’ve been on a journey of self realization and transformation for years-both as an individual and in partnership with Cash.”
The “Killers Anonymous” actress added, “I’m proud of how we’ve grown as a couple and in our marriage over the last 20 years and it’s now time for us to embark on a new chapter of growth and evolution as individuals.”
Alba concluded by requesting privacy for her family, adding that she and Warren planned to remain amicable despite their separation.
She wrote, “We are moving forward with love and kindness and respect for each other and will forever be family. Our children remain our highest priority and we request privacy at this time.”
